Terms and Conditions of security system for online transaction (EMV 3-D Secure)

This terms and conditions is a part of the terms and conditions for the use of credit card and/or KTC PROUD cash card which have been issued and operated by Krungthai Card Public Company Limited (“KTC”)(hereinafter collectively referred to as the “card”) and “you” or “your” means the cardholder who use EMV 3-D Secure system

1. Security system for online transaction EMV 3-D Secure is the system which is managed by Visa International Service Association, MasterCard International Incorporated, JCB Card International Incorporated, or other credit card business system (hereafter called “Card Company”) in order to verify identity, authentication, or identity proofing in every time when payment of good/service via website or application by the card in the form of answering question, informing information, or one time password which KTC and/or the issuer bank generate, or other method prescribed by the Card Company which estimate from the spending behavior of the cardholder.
2. Accept of Conditions

   (A) Payment of good/service via website and application by the card’s information which operate through EMV 3-D Secure system shall be subject to the terms and conditions for the use of credit card, policy and rule of the Card Company which specify to use with EMV 3-D Secure system, and this Terms and Conditions EMV 3-D Secure that may change or modify from time to time according to laws, rules, regulations, related announcement, terms and conditions for the use of credit card, and/or additional or change from time to time of the policy and rule of the Card Company which KTC will inform to you via website or other KTC’s communication channel.

   (B) KTC reserves the right to change/modify this Terms and Conditions EMV 3-D Secure, or suspend, or permanently discontinue EMV 3-D Secure system at any time.

3. Details of EMV 3-D Secure system
   EMV 3-D Secure is a system that enhance the security for your online transaction by reducing the risk card-not-present fraud from online shopping, and keep, record, create report to resolve dispute, or any dispute in the transaction. However, the personal information shall not to share with the merchant according to KTC’s privacy policy.
4. Privacy Policy
   Details according to Personal Data Protection Policy (http://www.ktc.co.th/pdpa), KTC website may link to the merchant’s website which sell goods or services. In case the merchant’s website collect your information, KTC’ website may collect the same information according to the agreement with the related merchant’s website, and you agree and give consent to KTC to collect the information from the merchant’s website.
5. Your Warranty
   You agree not to act as follows:
   

   (a) disguise and/or impersonate any person or entity using EMV 3-D Secure;

   (b) upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment used by EMV 3-D Secure;

   (c) spam or flood the EMV 3-D Secure website or system;

   (d) modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the EMV 3-D Secure website or system or the software used in connection with EMV 3-D Secure;

   (e) remove any copyright, trademark, or other proprietary rights notices contained in EMV 3-D Secure;

   (f) "frame" or "mirror" any part of the EMV 3-D Secure website or system without prior written authorization of the Card Company including any other incorporation, association or juristic person participating in credit card business with KTC in the future and providing the EMV 3-D Secure (as the case may be);

   (g) use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the EMV 3-D Secure website or system, or its contents;

   (h) otherwise interfere with, or disrupt, EMV 3-D Secure or servers or networks connected to EMV 3-D Secure, or violate this Terms and Conditions or any requirements, procedures, policies, or regulations of EMV 3-D Secure or of any networks connected to EMV 3-D Secure; or (i)  intentionally or unintentionally violate any applicable local, state, national or international statute (all of which shall constitute "Applicable Law"), including regulation, regulatory guideline or judicial or administrative interpretation, or any rule or requirement established by Card Association in connection with your use of EMV 3-D Secure.

6. Limit Liability
   You acknowledge and agree that online transaction via EMV 3-D Secure is your voluntary act, your own risk, and your responsibility. KTC will not involve in such responsibility and not warrant or insure any damages, success, or complete about online transaction of such system. You shall be liable to using the password, answering question, or informing information for identity verification, authentication, or identity proofing for online transaction (if any) and pay for such spending transaction.
7. Cancellation of Online Transaction via System
   KTC reserves the right to cancel, revoke, temporarily or permanently, the transaction via EMV 3-D Secure whether your fault or not if fraudulent activities are committed in online transaction.
8. Relation between KTC and Merchant
   KTC is not a merchant, product or service owner, manufacturer, distributor, or service provider and not involve regarding any goods/services which appear on website of the merchant that sell goods or services or promotion campaign of the merchant, and delivery of related goods/services including any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such merchant. Should there be any inquiries in validity or status of the merchant, or quality of goods/services of the merchant, please contact the manufacturer, distributor and/or the owner of product or service directly.
